PREAMBLE
LMG is a Simplified Joint Stock Company, registered in the Trade and Companies Register of EVREUX under the number 489.418.293 whose head office is located at 123, Rue Claude Monet – 27620 GIVERNY and whose intra-community VAT number is FR35 489 418 293. Its commercial name is La Musardière.
ARTICLE 1 – PURPOSE AND SCOPE OF APPLICATION
These General Terms and Conditions of Sale apply to all reservations made directly or via the Hotel La Musardière reservation site, subject to the special conditions applied by the partner sites or subject to the special conditions applied for certain rates. Any reservation made implies full and unconditional acceptance of the General Terms and Conditions of Sale; the client thus acknowledges having read them and agrees to abide by them.
ARTICLE 2 – RESERVATION / STAY
Reservations are made in advance according to the following methods:
1 – By telephone: in this case, the reservation is taken and confirmed directly;
2 – By mail : in this case, the reservation is taken and confirmed either by return of mail, or by telephone, or by e-mail;
3 – By email: in this case, the customer will receive a confirmation by email;
4 – By website: Booking or Eure Tourisme in this case, the customer is redirected to the website www.booking.com or www.eure-tourisme.fr which will make the reservation online and which has a system ensuring data protection.
Unless otherwise agreed, the reservation will only be confirmed after payment of a deposit or after registration of bank details (card number, expiry date, CCV and name of the holder) valid on the date of the stay.
The Hotel reserves the right to make a pre-authorization with the card, if it deems it necessary to verify the validity of the card. In the event of refusal to provide bank details, the Hotel will not guarantee the reservation. If the pre-authorization is rejected, the Hotel will inform the Customer. In this case, the Hotel reserves the right to cancel the reservation.
Payment for all services must be made directly to the Hotel (except for reservations prepaid at the time of reservation).
Hotel La Musardière accepts the following credit cards: Visa, Mastercard and American Express, and has a secure reservation system (SSL) that protects and encrypts all sensitive data transmitted at the time of reservation to prevent disclosure to a third party.
All children under 2 years stay free of charge when using the cots. Cribs are only available upon request at the time of booking. Availability must be confirmed by the hotel.
Small pets are allowed subject to payment of the daily fee. They must be notified at the time of booking.
All the equipment provided to the guests may be unavailable for technical reasons. The hotel cannot be held responsible for these incidents.
The hotel is completely non-smoking. It is therefore forbidden to smoke in the rooms. If, after the departure of the client, the Hotel notices a persistent smell of tobacco in the room, it may be charged an indemnity calculated according to the time spent for cleaning and deodorizing the room, the cost of the products used and the time of non-use, i.e. the number of nights lost by closing the room. The amount of the compensation can be taken from the credit card left as a guarantee.
ARTICLE 3 – ARRIVAL / DEPARTURE
The rooms are available from 3:00 pm (check-in) on the day of arrival and must be vacated by 11:00 am (check-out) on the day of departure. A surcharge of 35 € per hour of occupancy will be charged if the maximum check-out time is not respected.
In case of late arrival, i.e. after 9:00 pm, the reception must be notified so that the client receives the necessary information.
If the client does not vacate the room by 11:00 a.m., the hotel cannot guarantee that the room will be cleaned and the towels changed.
The client agrees to use the room in a responsible manner. Also, any behavior contrary to good morals and public order will lead the hotelier to ask the client to leave the establishment without any compensation or refund if a payment has already been made.
ARTICLE 4 – RATES
The rates indicated on our website or in the Hotel are expressed in €uros, all taxes included, and take into account the VAT applicable on the day of the reservation. Any change in the applicable rate, or any modification or introduction of new legal taxes introduced by the competent authorities, will be
The tourist tax of 0.95 € per night and per person (over 18 years old) is not included in the price displayed and must be paid directly on site.
Rates are per room for the number of people indicated; they are flexible and variable according to various customizable criteria such as the reservation date, the start date and/or the duration of the stay, the room category chosen and our availability.
Some services may be subject to a supplement and to possible modifications without prior notice, and the Hotel is not responsible for them. Thus, unless otherwise stated or specifically selected at the time of booking, additional services (such as breakfast, meals, drinks at the bar, etc.), without this list being exhaustive, are optional and will be invoiced as an extra and will be paid for at the time of departure.
No stay booked before the implementation of a possible promotional offer will be reimbursed, even partially.
ARTICLE 5 – MODIFICATION / CANCELLATION / PAYMENT
Any modification or cancellation of a reservation must be requested by e-mail to reservation@lamusardiere.fr or by mail to La Musardière 123, Rue Claude Monet 27620 GIVERNY.
The request will only become effective once Hotel La Musardière has confirmed its acceptance in writing.
In the event of modification or cancellation of a stay, the following conditions apply (except in the case of force majeure as defined in Article 7) as to the modifiable/non-modifiable or cancellable/non-cancellable character:
Stay of 1 to 2 nights: Communication of a bank card valid on the date of stay as a guarantee / Cancellation or modification without charge, possible until the 8th day before arrival. If the cancellation or modification occurs between the 7th and the 3rd day before the beginning of the stay an amount of 50% of the stay will be charged. Less than 72 hours before the stay, 100% of the stay will be charged.
Stay of 3 nights or more: Deposit of 50% of the total amount of the reservation / Cancellation or modification without charge, possible until the 8th day before the arrival. If the cancellation or modification occurs between the 7th day and the 3rd day before the beginning of the stay, the 50% deposit is kept by the hotel. Less than 72 hours before the start of the stay, 100% of the stay will be charged.
Special offers: Payment of the total amount of the stay at the time of the reservation, otherwise the reservation will not be guaranteed. Special offers are not exchangeable, refundable or modifiable.
Group stay from 4 rooms: Deposit of 50% of the total amount of the reservation / Cancellation or modification without charge possible until the 8th day before arrival. If the cancellation or modification occurs between the 7th day and the 3rd day before the beginning of the stay, the 50% deposit is kept by the hotel. Less than 72 hours before the stay, 100% of the stay will be charged.
In case of no-show on the scheduled arrival date and in the absence of cancellation, the credit card will be charged the total amount of the stay.
Any stay started is fully due. In case of interruption of the stay due to the client, the full amount of the agreed price will be charged to the credit card. In the case of a reservation with prepayment, no refund will be granted.
For reservations made via the website of our partners, the cancellation must be made via this site. The cancellation conditions that apply are then specific to the partner and may therefore be different from those of the Hotel La Musardière.
In case of extension of the stay, the customer must inform the reception of the Hotel at 10:00 am at the latest on the day of departure, in order to know the availability.
The beginning of the stay, for the computation of the time limits, starts at 00:01 (midnight one minute) Paris time, on the day of the beginning of the stay.
ARTICLE 6 – PAYMENT OF THE STAY
The payment of the stay and the extras is made at the counter at the time of departure. It can be done in cash, by credit card, in vacation vouchers. Bank checks are not accepted, except by prior agreement.
In the case of a deferred payment by a company, following an agreement with the Hotel’s management, the payment period may in no case exceed four weeks from the date of issue of the invoice. After this period, the Hotel reserves the right to charge late payment fees at the current annual rate and a collection fee of 40 €uros per invoice.
ARTICLE 7 – FORCE MAJEURE
Force majeure is any event external to the parties of an unforeseeable and insurmountable nature that prevents the client from carrying out all or part of the obligations provided for in the contract. This will be the case in particular in the event of a strike of means of transport, hotel staff, government or public riots.
ARTICLE 8 – COMPLAINTS
Any complaint must be addressed to Hôtel La Musardière 123, Rue Claude Monet 27620 GIVERNY by registered letter with acknowledgement of receipt, within 15 days following the departure of the stay that is the subject of said complaint.
After this period, no claim can be taken into account.
After having contacted the customer service (LMG – Service Réclamations – 123, Rue Claude Monet 27620 GIVERNY or at the email address lmg@lamusardiere.fr specifying in the subject of the email “Service Réclamations”) and in the absence of a satisfactory response within a period of fifteen (15) days, the customer may refer the matter to the Mediator of Tourism and Travel, whose contact details and methods of referral are available on his site: www.mtv.travel
ARTICLE 9 – DATA PROCESSING AND FREEDOM
In application of the French law 78-17, known as “informatique et libertés”, customers are informed that their reservation is subject to computerized personal data processing. The users have a right of access and rectification of the seized data, which is exerted near the head office: SAS LMG, 123 Rue Claude Monet 27620 GIVERNY. It is specified that this information is not communicated to third parties.
The Hotel La Musardière proposes an Internet access in wifi. The user customer agrees that the computer resources made available to him/her shall not be used in any way for the purposes of reproduction, representation, making available or communication to the public of works or objects protected by copyright or by a related right, such as texts, images, photographs, audiovisual musical works, software and video games, without the authorization of the holders of the rights provided for in Book I and II of the Intellectual Property Code, when such authorization is required.
ARTICLE 10 – LIABILITY
The Hotel declines all responsibility in the event of theft, loss or damage to the effects belonging to the clients during their stay.
The customer shall be held responsible for any damage, deterioration or act of vandalism that may occur as a result of the occupation of the premises and/or the actions of the participants and/or the staff for which he/she is responsible, whether or not they are movable, decorative or real estate assets belonging to the Hotel.
As a result, the Hotel La Musardière may ask the Client to leave the establishment without any compensation or reimbursement for the stay in progress, and to reimburse any damage caused by these acts.
ARTICLE 11 – APPLICABLE LAW
The present General Conditions of Sale are governed by French law. It is so for the rules of substance as for the rules of form. Disputes will fall under the exclusive jurisdiction of the French courts.
